Yes, Mark and I will do the welcome/introductions along with the instructions to stay muted and hold questions to the end and then turn it over to John.

If it goes late, we have decided to have them send additional questions to me that we will answer back via email.

Right now, we have close to 70 registrations. Which is about 20 more than last month.

Taking the PP takes some of the pressure off me while trying to admit people into the meeting.

Good morning Fwaak, and good to hear from you.

Yes, I’d be more than happy to talk with you about Flock and our partnership and integration with Axon. This is actually really good timing because we just had another HOA in Benicia sign up for their own cameras as of yesterday, so now there are two communities that have privately purchased cameras (Bridgeview Heights and Bay Vista). I’d like to talk with you about setting your agency up with access to those cameras as well.

The information from our previous deal is somewhat limited. We started the discussions back in November of 2019, and it looks like we were talking about approximately 20 LPR cameras although I do not see a deployment map in our system which means that we hadn’t discussed/finalized specific locations.

It looks like our most recent conversations were around January 2020, and a TON has changed since then. We’ve released a new version of the camera which is about 10x more effective, and it’s able to capture multiple lanes of traffic from a single camera compared to just one lane with the camera we would have discussed with you back in 2019.

We’ve also completely overhauled our Search Portal enabling a TON of new features like searching based on vehicle description (vehicle type, make, color, state detection, paper vs regular plates, more).

Here is some of my availability next week:

   Monday any time after 2:00
   Tuesday from 11:00 - 2:00 or after 3:00
   Wednesday after 2:00
   Thursday after 10:00

I have a slide in there with the pricing, but it’s incredibly simple. $2500/camera per year plus a one time $250 install fee (i.e. $2750/camera first year, $2500 after that).

You’re by no means expected to be an expert on Flock so I’d be more than happy to participate in a meeting with the Chief to answer any questions that come up.

On a personal, putting these solutions together is one of my favorite parts of this job and I love that the initial map you sent over is basically my ideal solution for Benicia. When I look at the City Wide Coverage map (slide 6) I can’t help but think that if Benicia had this solution, a person would have to be crazy to commit a crime in your city.

What is your feedback on these slides? I’d be more than happy to make changes or adjust based on what’s important to your team.

Sounds good. Is there any additional info that I can get you before that meeting?

A couple of exciting updates: I’ve been working with Fairfield PD as well, and things have been progressing quickly. Vallejo and Vacaville already have Flock, so once you and Fairfield become clients you’ll have a huge pool of cameras to leverage from the standpoint of camera sharing (Benicia, Vallejo, Fairfield, Vacaville).

Also, I was reviewing some of our recent results and noticed something interesting…We just installed solutions for Vallejo, Hercules, Milpitas, San Mateo, Atherton, Piedmont, Clearlake, and Anderson towards the end of 2020, and they’re getting such good results that all 8 are already in the process of adding additional cameras. It blows me away every time I think about it because the results they’re getting are actually typical.

Quick Recap:

     Benicia PD is looking to implement an ALPR solution for the city
     In preparation for going to City Council, they are going to conduct community outreach to HOA's,
     Neighborhoods, Neighborhood Watch Groups, and Businesses to involve the community in this decision
     Target date is 2/25 late afternoon or early evening for the first virtual event (likely to do 2 virtual meetings

We’re thinking that the virtual event will consist of four parts:

   1. Benicia PD will intro and talk about crime in the city, why they have decided to implement ALPR and
      partner with Flock, and the benefits to the community
   2. Flock (Me) will talk about the technology, solution, and Flock in general
   3. Flock (Jess/Meg) will talk about partnerships with neighborhoods, HOA's, how LPR can make communities
      safer, etc.

Goals are twofold:

   1. Engage the community so Benicia PD's project will be approved when it goes to Council
   2. Gain support with HOA's, Neighborhoods, and Business and plant the seed for them to fill in the gaps within
      their communities

Automated License Plate Reader Abuses by Police Foreshadow Abuses by Neighborhoods

Though police have used these tools for decades, communities have only recently had the ability to install their own ALPR systems. In that time, EFF and many others have criticized both ALPR vendors and law enforcement for their egregious abuses of the data collected.

Police abuse this technology regularly. And unfortunately, neighborhood users will likely do the same.

A February 2020 California State Auditor’s report on four jurisdictions’ use of this tech raised several significant concerns. The data collected is primarily not related to individuals suspected of crimes. Many agencies did not implement privacy-protective oversight measures, despite laws requiring it. Several agencies did not have documented usage or retention policies. Many agencies lack guarantees that the stored data is appropriately secure. Several agencies did not adequately confirm that entities they shared data with had a right to receive that information. And many did not have appropriate safeguards for users accessing the data.

California agencies aren’t unique: a state audit in Vermont found that 11% of ALPR searches violated state restrictions on when cops can and can’t look at the data. Simply put: police abuse this technology regularly. And unfortunately, neighborhood users will likely do the same.

In fact, the growing ease with which this data can be shared is only increasing. Vigilant Solutions, a popular vendor for police ALPR tech, shares this data between thousands of departments via its LEARN database. Flock, a vendor that aims to offer this technology to neighborhoods, has just announced a new nationwide partnership that allows communities to share footage and data with law enforcement anywhere in the country, vastly expanding its reach. While Flock does include several safeguards that Vigilant Solutions does not, such as encrypted video and 30-day deletion policies, many potential abuses remain.

Additionally, some ALPR systems can automatically flag cars that don’t look a certain way— from rusted vehicles to cars with dents or poor paint jobs—endangering anyone who might not feel the need (or have the income required) to keep their car in perfect shape. These “vehicle fingerprints” might flag, not just a particular license plate, but “a blue Honda CRV with damage on the passenger side door and a GA license plate from Fulton County.” Rather than monitoring specific vehicles that come in and out of a neighborhood via their license plate, “vehicle fingerprint” features could create a trouble drag-net style of monitoring. Just because a person is driving a damaged car from an accident, or a long winter has left a person’s car rusty, does not mean they are worthy of suspicion or undue police or community harassment.

Some ALPRs are even designed to search for certain bumper stickers, which could reveal information on the political or social views of the driver. While they aren’t in every ALPR system, and some are just planned, all of these features taken together increase the potential for abuse far beyond the dangers of collecting license plate numbers alone.

What You Can Tell Your Neighbors if You’re Concerned

Unfortunately, ALPR devices are not the first piece of technology to exploit irrational fear of crime in order to expand police surveillance and spy on neighbors and passersby. Amazon’s surveillance doorbell Ring currently has over 1,300 partnerships with individual police departments, which allow departments to directly request footage from an individual’s personal surveillance camera without presenting a warrant. ALPRs are at least as dangerous: they track our comings and goings; the data can indicate common travel patterns (or unique ones); and because license plates are required by law, there is no obvious way to protect yourself.

If your neighborhood is considering this technology, you have options. Remind your neighbors that it collects data on anyone, regardless of suspicion. They may think that only people with something to hide need to worry—but hide what? And from who? You may not want your neighbor knowing what time you leave your neighborhood in the morning and get back at night. You may also not want the police to know who visits your home and for how long. While the intention is to protect the neighborhood from crime, introducing this kind of surveillance may also end up incriminating your neighbors and friends for reasons you know nothing about.

You can also point out that ALPRs have not been shown to reduce crime. Likewise, consider sending around the California State Auditor’s report on abuses by law enforcement. And if the technology is installed, you can (and should) limit the amount of data that’s shared with police, automatically or manually. Remind people of the type of information ALPRs collect and what your neighbors can infer about your private life. If you drive a car, you’re likely being tracked by ALPRs, at least sometimes. But that doesn’t mean your neighborhood should contribute to the surveillance state. Everyone ought to have a right to pass through a community without being tracked, and without accidentally revealing personal details about how they spend their day. Automatic license plate readers installed in neighborhoods are a step in the wrong direction. Hi Mark, I’ve attached some info on our security policies that you can share. I don’t know all of the details on that situation, but I’m hearing that the issues at Verkada could have been avoided had the user been using 2FA.

We also have several additional things that we do internally to enhance security, although I’m not sure what I’m allowed to share publicly so potentially more to come.

Also, Matt Feury is our CTO and Co-Founder, and he oversees everything security related here at Flock. Matt is planning on joining us for the City Council meeting whenever it’s scheduled.

At last night's meeting I asked if Flock had a security team, they could
not give an answer if they had a team dedicated to security. Looking
at their LinkedIn and the company website, I could find no instance
that they had a dedicated team that took care of securing their
product. I feel like Flock is not a mature enough company and does
not solve the problems they claim to solve. Regardless of the civil
rights issues with putting cameras in our community, I fear that if
hackers got access to the data collected it would be detrimental to
Benicia's reputation, opening the city up to litigation.

I will be bringing these concerns in a public manner to the city
council meeting where you decide to approve the budget, I decided
to email you some information I was able to find beforehand based
on the current news today. If you want to know more about the
insecurity of systems like these, please feel free to reach out. I have
contacts at the Electronic Frontier Foundation who have been doing
this kind of research for years and have data to back up that these
systems are personal data risks that we don't need to be taking on.

Currently, BPD employs several license plate readers on its existing fleet of vehicles. However, there are countless cars in Benicia that display evidence of license plate tampering, some in highly visible locations for several months/years. This method of obfuscation not only cheats our communities of tax revenues at tolls and other camera operated devices, but it could also prevent the identification of guilty persons in traffic accidents. Aren’t the mobile license plate readers designed to recognize this illegal activity? Shouldn’t officers without the benefit of this technology be addressing these situations? Even if the owner claims to have purchased the vehicle in this condition, they are still legally obligated to have the plates replaced by the California Department of Motor Vehicles.

I hope you’re doing well and had a great week. Someone posted to Facebook about the Police Department’s plan to add safety cameras/license plate readers throughout the community. While I don’t have an issue with the technology itself, I may be opposed to the financial burden. Are you able to share how much this is going to cost initially, the ongoing expected costs, any changes to personnel (ie, would the department need to hire more employees to monitor/maintain the cameras), and where that money is going to come from? I would also expect (and correct me if I’m wrong) that since the department is a public entity there will be due diligence in the form of a RFP to get bids from multiple companies for this service. That would also be helpful information in determining whether or not it’s something I would support. I imagine other residents of Benicia would also find that information helpful.

Lt. Menesini and Irma, I’d like to introduce you to Meg Heusel and Jessica Wunder.

Meg heads up our Community Engagement team, and Jessica is my counterpart who works with Neighborhoods and HOA’s.

Quick Recap:

  Benicia PD is looking to implement an ALPR solution for the city
  In preparation for going to City Council, they are going to conduct community
  outreach to HOA's, Neighborhoods, Neighborhood Watch Groups, and
  Businesses to involve the community in this decision
  Target date is 2/25 late afternoon or early evening for the first virtual event
  (likely to do 2 virtual meetings with subsets of the groups)

We’re thinking that the virtual event will consist of four parts:

Benicia PD will intro and talk about crime in the city, why they have decided to implement ALPR and partner with Flock, and the benefits to the community
Flock (Me) will talk about the technology, solution, and Flock in general
Flock (Jess/Meg) will talk about partnerships with neighborhoods, HOA’s, how LPR can make communities safer, etc.
Q&A

Goals are twofold:

Engage the community so Benicia PD’s project will be approved when it goes to Council
Gain support with HOA’s, Neighborhoods, and Business and plant the seed for them to fill in the gaps within their communities

Next Step: Benicia PD to come up with a more structured outline for the topics that they’d like to cover during their section of the discussion (@Meg Heusel, do you have any suggestions here?)

Hey Mark, does your agency have an ALPR policy in place? I just searched for it and all I found was where your agency links to NCRIC here, but I’m pretty sure that’s actually an old version:

I’d imagine that Benicia is going to come up against similar resistance as Vallejo, so I think it might be a good idea to take this as an opportunity to establish your own policy (disclaimer: I’m not a legal expert, I just work with a lot of agencies and in my experience, I think this is an important step).

Vallejo’s turned out great so I’ve attached it along with a couple of others that I like (I plan on going through each of these and highlighting the aspects that I like, but I haven’t gotten around to it…ALPR policies is coming up more and more frequently so I may make this a priority).

What do you think? I’d be happy to jump on a call with you and your team to discuss.

Hello Mayor and Council members,

At last night's meeting I asked if Flock had a security team, they could
not give an answer if they had a team dedicated to security. Looking at
their LinkedIn and the company website, I could find no instance that
they had a dedicated team that took care of securing their product. I
feel like Flock is not a mature enough company and does not solve the
problems they claim to solve. Regardless of the civil rights issues with
putting cameras in our community, I fear that if hackers got access to
the data collected it would be detrimental to Benicia's reputation,
opening the city up to litigation.

I will be bringing these concerns in a public manner to the city council
meeting where you decide to approve the budget, I decided to email
you some information I was able to find beforehand based on the
current news today. If you want to know more about the insecurity of
systems like these, please feel free to reach out. I have contacts at the
Electronic Frontier Foundation who have been doing this kind of
research for years and have data to back up that these systems are
personal data risks that we don't need to be taking on.

Meg heads up our Community Engagement team, and Jessica is my counterpart who works with Neighborhoods and HOA’s.

Quick Recap:

     Benicia PD is looking to implement an ALPR solution for the city
     In preparation for going to City Council, they are going to conduct community outreach to HOA's,
     Neighborhoods, Neighborhood Watch Groups, and Businesses to involve the community in this decision
     Target date is 2/25 late afternoon or early evening for the first virtual event (likely to do 2 virtual meetings
     with subsets of the groups)

We’re thinking that the virtual event will consist of four parts:

   1. Benicia PD will intro and talk about crime in the city, why they have decided to implement ALPR and
      partner with Flock, and the benefits to the community
   2. Flock (Me) will talk about the technology, solution, and Flock in general
   3. Flock (Jess/Meg) will talk about partnerships with neighborhoods, HOA's, how LPR can make communities
      safer, etc.
   4. Q&amp;A

Goals are twofold:

   1. Engage the community so Benicia PD's project will be approved when it goes to Council
   2. Gain support with HOA's, Neighborhoods, and Business and plant the seed for them to fill in the gaps within
      their communities

Next Step: Benicia PD to come up with a more structured outline for the topics that they’d like to cover during their section of the discussion (@Meg Heusel, do you have any suggestions here?)

Lt. Menesini and Irma, I’d like to introduce you to Meg Heusel and Jessica Wunder.

Meg heads up our Community Engagement team, and Jessica is my counterpart who works with Neighborhoods and HOA’s.

Quick Recap:

  Benicia PD is looking to implement an ALPR solution for the city
  In preparation for going to City Council, they are going to conduct community
  outreach to HOA's, Neighborhoods, Neighborhood Watch Groups, and
  Businesses to involve the community in this decision
  Target date is 2/25 late afternoon or early evening for the first virtual event
  (likely to do 2 virtual meetings with subsets of the groups)

We’re thinking that the virtual event will consist of four parts:

Benicia PD will intro and talk about crime in the city, why they have decided to implement ALPR and partner with Flock, and the benefits to the community
Flock (Me) will talk about the technology, solution, and Flock in general
Flock (Jess/Meg) will talk about partnerships with neighborhoods, HOA’s, how LPR can make communities safer, etc.
Q&A

Goals are twofold:

Engage the community so Benicia PD’s project will be approved when it goes to Council
Gain support with HOA’s, Neighborhoods, and Business and plant the seed for them to fill in the gaps within their communities

Next Step: Benicia PD to come up with a more structured outline for the topics that they’d like to cover during their section of the discussion (@Meg Heusel, do you have any suggestions here?)

How does this sound to everyone, and I’m sure we can jump on a call as a group to iron things out further.
