Public records request — NCRIC records concerning Benicia PD ALPR data

To the NCRIC Records Custodian:
Pursuant to the California Public Records Act, Government Code § 7920.000 et seq., I am requesting copies of the following public records maintained by the Northern California Regional Intelligence Center (NCRIC):

The executed Memorandum of Understanding (MOU) and/or Data Sharing Agreement between NCRIC and the City of Benicia Police Department, including all attachments, exhibits, and amendments currently in effect.

Any records showing whether Automated License Plate Reader (ALPR) data collected by the Benicia Police Department (including data from Flock Safety cameras) is transmitted to, stored by, or made searchable through NCRIC systems.

Records describing the technical mechanism by which any such ALPR data is shared with NCRIC, including whether the transfer is automatic/real-time, batch upload, or query-based access.

NCRIC’s current policy or procedures governing onward sharing of ALPR or other member-agency data with federal partners, including but not limited to the Department of Homeland Security, Immigration and Customs Enforcement, the FBI, or any Joint Terrorism Task Force, and any agreements governing such access.

A list of federal agencies, task forces, or fusion center partners (including other members of the National Network of Fusion Centers) with any current ability to query, receive, or otherwise access data originating from Benicia Police Department, whether directly or through NCRIC systems.

Any NCRIC policy specific to ALPR data (as distinct from your general UAS or intelligence-sharing policies), including retention periods and access-logging requirements.

Any records of requests, inquiries, or data pulls involving Benicia Police Department ALPR data made by outside agencies through NCRIC in the past 24 months, with personally identifiable information of non-employee subjects redacted rather than the records withheld.
If NCRIC takes the position that any of these records are more appropriately addressed to the City of Benicia as the originating Member Agency, I ask that you specify which items fall under that referral and confirm that NCRIC is providing notice to Benicia PD, consistent with NCRIC’s own MOU practice of referring member-agency records requests while independently producing any records that NCRIC itself created, maintains, or possesses regarding data sharing policies, participation lists, or onward-access agreements — as these latter categories are NCRIC’s own records, not Benicia’s.
Please provide responsive records in electronic format where available. If any portion of this request is denied, please cite the specific statutory exemption relied upon for each withheld record, as required under Government Code § 7922.000.
