Dear Gregg Horton,
This letter shall serve as the City’s further formal written response to your request under the California Public Records Act (Government Code section 7920.000 et seq.).
Under established California Law, the City is obliged to comply with a request for a public record so long as the requestor makes a specific and focused request for information, that information is maintained by the City in its ordinary course of business, the information is disclosable, and the record can be located with reasonable effort. The Public Records Act provides for the inspection or copying of existing identifiable public records; it does not compel the City to create new records, lists, privilege logs or reports in response to a request.
You have recently clarified your request as follows:
To clarify the portion of PR-2026-155 referenced in your letter, I am seeking the following, specific to Benicia PD’s Flock Safety ALPR system:

Any screenshot, export, or system report showing the current on/off status of national lookup, nationwide search, and statewide search settings for Benicia’s network

Any log, whether generated by Flock’s platform or maintained separately by BPD, showing dates and users associated with changes to those settings

Any vendor documentation, training material, or internal memo describing how those settings can be bypassed, overridden, or circumvented, including through 1:1 sharing agreements with individual outside agencies
If BPD does not independently retain records in categories 2 or 3, a written confirmation that no such records exist or are maintained by the City would itself satisfy this portion of the request.
The City provided a response and asserted an extension to look further into your request to try to identify responsive records. The City now provides the following update regarding the clarified items:
To item 1: The City has no responsive records. The City continues to assert that creating a screenshot amounts to creating a record, which the City declines to do at this time. There is not a function to export the information you requested.
To item 2: The City requires additional time to locate and review the record requested.
To item 3: The City has no responsive records.
The City will continue to search for records responsive to the remaining portion of this request and will provide an update by September 4, 2026.
