PublishedwithpermissionbyBeniciaPoliceDepartment Automated License Plate Readers(ALPRs)- AutomatedLicensePlateReaders(ALPRs) 470.1PURPOSEANDSCOPE data obtained through the use of Automated License Plate Reader (ALPR) technology. 470.2POLICY Thepolicyof theBeniciaPoliceDepartment is to utilizeALPRtechnologytocapture and s of the public. AlldataandimagesgatheredbytheALPRarefortheofficialuseofthisdepartment. Becausesuchdatamaycontainconfidentialinformation,itisnotopentopublicreview. 470.3ADMINISTRATION automateddetectionoflicenseplates.ItisusedbytheBeniciaPoliceDepartmentto convertdataassociatedwithvehiclelicenseplatesforofficiallawenforcementpurposes, includingidentifyingstolenorwantedvehicles,stolenlicenseplatesandmissingpersons. Itmayalsobeusedtogatherinformationrelatedtoactivewarrants,homelandsecurity, AllinstallationandmaintenanceofALPRequipment,aswellasALPRdataretentionand access,shallbemanagedbytheServicesDivisionCommander.TheServicesDivision Commanderwillassignmembersunderhis/hercommandtoadministertheday-to-day operationoftheALPRequipmentanddata. 470.3.1ALPRADMINISTRATOR includes,butisnotlimited to(Civil CodeS1798.90.51;Civil Codes1798.90.53): (a) A description of the job title orother designation of themembers and independent contractorswhoareauthorized touseoraccesstheALPRsystemortocollectALPR information. (b) Training requirements for authorized users. (c) A description of how theALPRsystem will be monitored toensure the securityofthe informationandcompliancewithapplicableprivacylaws. (d)Procedures for system operators to maintain records of access in compliance with CivilCodeS1798.90.52. (e)ThetitleandnameofthecurrentdesigneeinoverseeingtheALPRoperation. (g) Ensuring this policy and related procedures are conspicuouslyposted on the department'swebsite. 470.4OPERATIONS notuse,orallowotherstousetheequipmentordatabaserecordsforanyunauthorized purp0se (Civit Code s 1798.90.51; Civil Code s 1798.90.53). (a) AnALPRshall onlybeused forofficial lawenforcementbusiness. (b) An ALPR may be used inconjunctionwith any routinepatrol operationor criminal investigation.Reasonablesuspicion orprobable cause is not required before using anALPR. (c)WhileanALPRmaybeusedtocanvasslicenseplatesaroundanycrimescene, areasaroundhomicides,shootingsandothermajorincidents.Partiallicenseplates toidentifysuspectvehicles. (d) Nomemberof thisdepartment shalloperate ALPR equipmentor access ALPR data withoutfirstcompletingdepartment-approvedtraining. (e) No ALPR operator may access department, state or federal data unless otherwise authorizedtodoso. (f) If practicable,the officershouldverify anALPR response through the California Law Enforcement Telecommunications System (CLETS) before takingenforcement action thatisbasedsolelyonanALPRalert. 470.5DATACOLLECTIONANDRETENTION TheServicesDivisionCommanderisresponsibleforensuringsystems andprocessesare inplaceforthepropercollectionandretentionofALPRdata.Datawillbetransferredfrom AllALPRdatadownloadedtotheservershouldbestoredforaminimumofoneyear (GovernmentCodeS34090.6)andinaccordancewiththeestablishedrecordsretention schedule.Thereafter,ALPRdatashouldbepurgedunlessithasbecome,oritisreasonable tobelieveitwillbecome,evidenceinacriminalorcivilactionorissubjecttoadiscovery datashouldbedownloadedfromtheserverontoportablemediaandbookedinto evidence. 470.6ACCOUNTABILITY All data will be closely safeguarded andprotected by both procedural and technological means. (a) All ALPR data downloaded to themobileworkstation and instorage shallbe accessible ofinformationbyname,dateandtime(Civil Codes1798.90.52). (b) Members approved to access ALPR data under these guidelines are permitted to accessthedataforlegitimatelawenforcementpurposesonly,suchaswhenthedata relate to a specificcriminalinvestigation or department-related civil or administrative action. (c)ALPRsystemauditsshouldbeconductedonaregularbasis. 470.7RELEASINGALPRDATA TheALPRdatamaybesharedonlywithotherlawenforcementorprosecutorialagencies procedures: (a) The agency makes a written request forthe ALPR data that includes: 1.Thenameoftheagency. 2.The name of thepersonrequesting. 3.Theintendedpurposeofobtainingtheinformation. (b) Therequest is reviewed bythe Services Division Commander orthe authorized designeeandapprovedbeforetherequestisfulfilled. (c)The approvedrequestisretainedonfile. RequestsforALPRdatabynon-lawenforcementornon-prosecutorialagencieswillbe processes as provided in the Records Maintenance and Release Policy(Civil Code S 1798.90.55). 470.8TRAINING TheTraining Sergeant should ensure that members receive department-approved training forthoseauthorized touseoraccesstheALPRsystem(CivilCodes1798.90.51;Civil Code $1798.90.53).
