PublishedwithpermissionbyBeniciaPoliceDepartment Automated License Plate Readers(ALPRs)- AutomatedLicensePlateReaders(ALPRs) 470.1PURPOSEANDSCOPE The purpose of this policy is to provide guidance forthe capture, storage and use of digital data obtained through the use of Automated License Plate Reader (ALPR) technology. 470.2DEFINITIONS technology to compare digital images to lists of known information of interest. (d) Hot List:A list of license plates associated withvehicles of interest compiled from one ormoredatabasesincluding,butnot limited to,NCIC,CADMV,LocalBOLO's,etc. (e) Vehicles of Interest: Including, but not limited to vehicles which are reported as stolen; displaystolen licenseplatesortags;vehicleslinkedtomissingand/orwantedpersons and agencies. descriptionofvehicleonwhichitwasdisplayed),andinformationregardingthelocationof theALPRsystematthetimeoftheALPR'sread. (g)Hit:AlertfromtheALPRsystemthatascanned licenseplatenumbermaybeinthe National Crime Information Center(NCiC) or other law enforcement database fora specificreasonincluding,butnotlimitedto,beingrelatedtoastolencar,wantedperson, missingperson,domesticviolationprotectiveorderorterrorist-relatedactivity. 470.3ADMINISTRATION automateddetectionoflicenseplatesalongwiththevehiclemake,model,colorand uniqueidentifiersthroughtheBeniciaPoliceDepartment'sALPR'ssystemand thevendor's vehicleidentificationtechnology. vehiclelicenseplatesandvehicledescriptionsforofficiallawenforcementpurposes, includingidentifyingstolenorwantedvehicles,stolenlicenseplatesandmissingpersons. It may alsobeused togatherinformationrelated toactivewarrants,homelandsecurity, suspectinterdictionandstolenpropertyrecovery. TheDepartmentInformationTechnologyManagerwillassignmembersunderhis/her 470.3.1ALPRADMINISTRATOR CodeS1798.90.5etseq.Thisincludes,butis not limited to(Civil CodeS1798.90.51;Civil CodeS1798.90.53): allowedaccesstotheALPRsystemortocollectALPRinformation. (b)Ensuringthattrainingrequirementsarecompletedforauthorizedusers. applicableprivacylaws. ContinuallyworkingwiththeCustodianofRecordsontheretentionanddestructionof ALPRdata. (f) Ensuring this policy and related procedures are conspicuously posted on the department'swebsite. 470.4OPERATIONS notuseorallowotherstousetheequipmentordatabaserecordsforanyunauthorized purp0se (Civil Code s 1798.90.51; Civil Code s 1798.90.53). (a)AnALPRshallonlybeusedforofficiallawenforcementbusiness. (b) An ALPR may be used in conjunction with any routine patrol operation or criminal investigation. (c)Partial licenseplatesanduniquevehicledescriptionsreportedduringmajorcrimes should be entered into the ALPR system in an attempt to identify suspect vehicles. (d) No memberof this department shall operate ALPRequipment or access ALPR data withoutfirstcompletingdepartment-approvedtraining. thatisbasedsolelyonanALPRalert.Onceanalertisreceived,theOfficershouldconfirm that the observed license platefrom the system matches the licenseplate of the observed vehicle.Before anylaw enforcement action is takenbecause of anALPR alert,the alert will beverified througha CLETSinquiryviaMDCorthroughDispatch.Officerswill nottake any policeactionthatrestrictsthefreedomofanyindividualbasedsolelyonanALPRalert unlessithasbeenvalidated.BecausetheALPRalertmayrelatetoavehicleandmaynot relatetothepersonoperatingthevehicle,Officersareremindedthattheyneedtohave (Forexample,ifavehicleisenteredintothesystembecauseofitsassociationwitha wanted individual,Officersshould attempttovisuallymatchthe drivertothe description of the wanted subject prior to making the stop or should have another legal basis for making the stop.) (f) Hot Lists. Designation of hot lists to be utilized by the ALPR system shall be made by the ALPRAdministratororhis/herdesignee.Hotlistsshallbeobtainedorcompiledfrom sources as may be consistent with the purposes of the ALPR system set forth in this Policy. HotlistsutilizedbytheDepartment'sLPRsystemmaybeupdatedbyagencysourcesmore systemwill nothaveaccesstorealtimedata.Occasionally,theremaybeerrorsintheLPR system'sreadofalicenseplate. Therefore,analertaloneshall notbeabasisforpoliceaction(otherthanfollowingthe alert,Departmentmembersshallundertakethefollowing: (1)Verificationofstatusona HotList.Anofficermustreceiveconfirmation,from a that the licenseplate is still stolen,wanted,orotherwise of interest beforeproceeding (absentexigentcircumstances). (h) Login/Log-Out Procedure. (2) Harassment or Intimidation: It is a violation of this Policy to use the ALPR system to harass and/or intimidate any individual orgroup. (3) UseBasedonaProtected Characteristic.Itisaviolationofthispolicytouse theALPR system or associated scan files or hot lists solely because of a person's, or group's race, gender,religion,political affiliation,nationality,ethnicity,sexual orientation,disability,r otherclassificationprotectedbylaw. (4)PersonalUse:Itis aviolationof thisPolicytousetheALPRsystemorassociatedscan filesorhotlistsforanypersonalpurpose. (5)FirstAmendmentRights.ItisaviolationofthispolicytousetheLPRsystemor associatedscanfilesorhotlistsforthepurposeorknowneffectofinfringinguponFirst Amendmentrights. Anyone who engages in an impermissible use of the ALPR system or associated scan files orhotlistsmaybesubjectto: criminalprosecution civil liability,and/or · administrative sanctions, up to and including termination, pursuant to and consistent 470.5DATACOLLECTIONANDRETENTION andsecurityofdatastoredintheirdatatowers.FlockSafetywillpurgetheirdataattheend of the30daysofstorage.However,thiswillnotprecludeBeniciaPoliceDepartmentfrom maintaininganyrelevantvehicledataobtainedfromthesystem afterthatperiodpursuant totheestablishedCityofBeniciaretentionschedule. RestrictionsonuseofALPRData:Informationgatheredorcollected,andrecordsretained sold,accessed,orused forany purpose otherthan legitimate law enforcementorpublic safetypurposes. 470.6ACCOUNTABILITYANDSAFEGUARDS All data will be closely safeguarded and protected by both procedural and technological means. (a)Allnon-lawenforcementrequestsforaccesstostoredALPRdatashallbeprocessed in accordancewithapplicablelaw. es thedataforlegitimatelawenforcementpurposesonly,suchaswhenthedatarelatetoa (c)SuchALPRdatamaybereleasedtootherauthorizedandverifiedlawenforcement (d)EveryALPRDetectionBrowsingInquirymustbedocumentedbyeithertheassociated For security or data breaches, see the Records Release and Maintenance Policy. 470.7POLICY ThepolicyoftheBeniciaPoliceDepartmentistoutilizeALPRtechnologytocaptureand ofthepublic. AlldataandimagesgatheredbytheALPRarefortheofficialuseofthisdepartment. Becausesuchdatamaycontainconfidentialinformation,itisnotopentopublicreview. Cityoritscontractors/subcontractorsforpurposeoffederalimmigrationenforcement, pursuanttotheCaliforniaValuesAct(GovernmentCodeS7282.5;GovernmentCodeS 7284.2etseq)-thesefederalimmigrationagenciesincludeImmigrationsandCustoms Enforcement(ICE)andCustomsandBorderPatrol(CPB). 470.8ALPRDATADETECTIONBROWSINGAUDITS Itis theresponsibilityoftheServicesLieutenantortheChief'sdesigneetoensurethatan audit is conducted of ALPR detection browsing inquiries at least quarterly during each calendaryear. shallrandomlyselectatleast10detectionbrowsinginquiriesconductedbydepartment requirementsestablished in policy section 470.5(e). The audit shall be documented in the form of an internal department memorandum to the Chief of Police. The memorandum shall include any data errorsfoundsothatsucherrorscanbecorrected.AfterreviewbytheChiefofPolice,the memorandumandanyassociateddocumentationshallbefiledandretainedbyBenicia Police Department. 470.9RELEASINGALPRDATA TheALPRdatamaybesharedonlywithotherlawenforcementorprosecutorialagencies theshareddatawillonlybeusedforthepurposesthatarealignedwiththeBeniciaPolice Department'spolicy.TheBeniciaPoliceDepartmentdoes notpermit thesharingofALPR datagatheredbytheCityoritscontractors/subcontractorsforpurposeoffederal immigration enforcement, these federal immigration agencies include Immigrations and CustomsEnforcement(ICE)andCustomsandBorderPatrol(CPB). (b) The signed letter is retained on file.Requests for ALPRdata bynon-law enforcement or nonprosecutorialagencieswillbeprocessedasprovided intheRecordsMaintenanceand ReleasePolicy(Civil Codes1798.90.55). 470.10TRAINING The TrainingSergeant should ensure that members receive department-approved training forthoseauthorized touseoraccesstheALPRsystem(CivilCodes1798.90.51;CivilCode $1798.90.53).
