Published withpermission byBenicia PoliceDepartment AutomatedLicensePlateReaders(ALPRs)- Automated LicensePlateReaders(ALPRs) 470.1PURPOSEANDSCOPE The purpose of this policy is to provide guidance for the capture, storage and use of digital data obtained through theuseof Automated LicensePlateReader(ALPR)technology. 470.2DEFINITIONS technology to compare digital images to lists of known information of interest. (b) ALPROperator:TrainedDepartment memberswho may utilize ALPR system/equipment. (d) Hot List:A list of license plates associated withvehicles of interest compiled from one ormoredatabasesincluding,butnot limitedto,NCIC,CADMV,LocalBOLO's,etc. (e) Vehicles of Interest: Including,but not limited tovehicles which are reported as stolen; displaystolenlicenseplatesortags;vehicleslinkedtomissingand/orwantedpersons and vehicles flagged by the Department of Motor Vehicle Administration or law enforcement agencies. (f) Detection: Data obtained by an ALPR of an image (such as a license plate) within public viewthatwasreadbythedevice,includingpotentialimages(suchastheplateand descriptionofvehicleonwhichitwasdisplayed),andinformationregardingthelocationof theALPRsystematthetimeoftheALPR'sread. (g)Hit:AlertfromtheALPRsystemthatascannedlicenseplatenumbermaybeinthe NationalCrimeInformationCenter(NCiC)orotherlawenforcementdatabasefora missingperson,domesticviolationprotectiveorderorterrorist-related activity. 470.3ADMINISTRATION automateddetectionof licenseplatesalongwiththevehiclemake,model,colorand uniqueidentifiersthroughtheBeniciaPoliceDepartment'sALPR'ssystemandthevendor's vehicleidentificationtechnology. vehiclelicenseplatesandvehicledescriptionsforofficiallawenforcementpurposes, It may also be used to gatherinformation related to active warrants, homeland security, All installation and maintenance of ALPR equipment, as well as ALPR data retention and access,shallbemanagedbytheDepartmentInformationTechnologyAnalystandRecords Supervisor. TheDepartment InformationTechnology Manager will assign membersunder his/her commandtoadministertheday-to-dayoperationoftheALPRequipmentanddata. 470.3.1ALPRADMINISTRATOR The ServicesLieutenantshall beresponsibleforcompliancewith therequirements of Civil Codes 1798.90.5et seq.This includes,butis not limited to(Civil Code s 1798.90.51; Civil CodeS1798.90.53): (a) Only properly trained sworn officers, crime analysts, and public safety dispatchers are allowedaccesstotheALPRsystemortocollectALPRinformation. (b) Ensuring that training requirements are completed for authorized users. (c) ALPR system monitoring to ensure the security of the information and compliance with applicableprivacylaws. (d) Ensuringthat procedures are followed for system operators and tomaintainrecordsof accessincompliancewithCivilCodes1798.90.52. maintained.ContinuallyworkingwiththeCustodianofRecordsontheretentionand destructionofALPRdata. (f)Ensuringthispolicyandrelatedproceduresareconspicuouslypostedonthe department'swebsite. 470.4OPERATIONS notuseorallowotherstousetheequipmentordatabaserecordsforanyunauthorized purp0se (Civil Code s 1798.90.51; Civil Code s 1798.90.53). (a) AnALPR shall onlybeused for official lawenforcement business. (b) An ALPR may be used in conjunction with any routine patrol operation or criminal investigation. (c)Partial licenseplatesanduniquevehicledescriptionsreportedduringmajorcrimes shouldbeentered intotheALPRsysteminanattempttoidentifysuspectvehicles. (d) No member of this department shall operate ALPR equipment or access ALPR data withoutfirstcompletingdepartment-approvedtraining. (e) If practicable, the Officer should verify an ALPR response through the California Law Enforcement Telecommunications System(CLETS) before taking enforcement action that isbasedsolelyonanALPRalert.Onceanalertisreceived,theOfficershouldconfirm that the observed license platefrom the system matches the license plate of the observed be verified through a CLETS inquiry via MDC or throughDispatch.Officers will not take any policeactionthatrestrictsthefreedomofanyindividualbasedsolelyonanALPRalert unlessithasbeenvalidated.BecausetheALPRalertmayrelatetoavehicleandmaynot relatetothepersonoperatingthevehicle,Officersareremindedthattheyneedtohave (Forexample,ifavehicleisenteredintothesystembecauseofitsassociationwitha wantedindividual,Officersshouldattempttovisuallymatchthedrivertothedescriptionof the wanted subject prior to making the stop or should have another legal basis for making thestop.) (f) Hot Lists.Designation of hot lists to be utilized by the ALPR system shall be made bythe ALPRAdministratororhis/herdesignee.Hotlistsshallbeobtainedorcompiledfrom Hot listsutilizedbytheDepartment'sLPRsystemmaybeupdatedbyagencysourcesmore frequently than the Department maybe uploading them and thus the Department's LPR systemwill nothaveaccesstoreal timedata.Occasionally,theremaybeerrorsintheLPR system'sreadofalicenseplate. Therefore,analertaloneshallnotbeabasisforpoliceaction(otherthanfollowingthe vehicleofinterest).Priortoinitiationofastopofavehicleorotherinterventionbasedonan alert, Department members shall undertake the following: (1)Verificationof statuson a Hot List.Anofficermustreceiveconfirmation,from a thatthelicenseplateisstillstolen,wanted,orotherwiseofinterestbeforeproceeding (absentexigentcircumstances). (2)Visualverificationoflicenseplatenumber.Officersshallvisuallyverifythatthe licenseplateofinterestmatchesidenticallywiththeimageofthelicenseplate numbercaptured(read)bytheLPR,includingboththealphanumericcharactersofthe licenseplate,stateofissue,andvehicledescriptorsbeforeproceeding Department members alerted to thefact that an observed motorvehicle's licenseplate is enteredasaHotPlate(hit)inaspecificBOLO(beonthelookout) listarerequiredtomakea reasonableefforttoconfirm that a wantedperson isactually inthevehicle and/orthat a reasonablebasisexistsbeforeaswornOfficerwouldhavealawfulbasistostopthe vehicle. (3) Officerswill clear all stops fromhot list alertsbyindicating thepositive ALPR Hit,i.e., withanarrestorotherenforcementaction.Ifitisnotobviousinthetextofthecallastothe correlationoftheALPRHitandthearrest,thentheOfficersshallupdatewiththe vehicleinthehotlist(hit). (5) All entries and updates of specific Hot Lists within the ALPR system will be documented Hot Lists shall be approved by the ALPR Administrator (or his/her designee) before initial entrywithintheALPRsystem.TheupdatingofsuchalistwithintheALPRsystemshall thereafterbeaccomplishedpursuanttotheapprovaloftheOfficer'simmediatesupervisor. The hitsfrom these data sources should beviewed as informational;created solelyto bring theofficersattentiontospecificvehicles thathavebeenassociatedwithcriminalactivity. AllHotPlatesandsuspectinformationenteredintotheALPRsystemwillcontainthe followinginformationasaminimum: ·EnteringDepartment member's name ·Relatedcasenumber. ·Shortsynopsisdescribingthenatureoftheoriginatingcall (g) Training. No member of this Department shall operate ALPR equipment or access ALPR datawithoutfirstcompletingDepartment-approvedtraining. (h) Login/Log-Out Procedure.To ensureproper operation and facilitate oversight of the ALPR system,all users will berequired to have individual credentials for access and use of the systems and/or data,which has the ability tobe fully audited. Permitted/lmpermissibleUses.TheALPRsystem,and alldatacollected,istheproperty of theBeniciaPolice Department.Department personnel mayonlyaccess and use the warrant,isaviolationofthisPolicytoutilizetheALPRtorecordlicenseplatesexceptthose of vehicles that are exposed to public view(e.g., vehicles on a public road or street, orthat placetowhichmembersofthepublichaveaccess,suchastheparkinglotofashopor otherbusinessestablishment). harass and/orintimidate any individual orgroup. (3)UseBasedonaProtectedCharacteristic.Itisaviolationof thispolicytousetheALPR system or associated scan files or hot lists solely because of a person's, or group's race, gender, religion, political affiliation, nationality, ethnicity, sexual orientation, disability, or otherclassificationprotectedbylaw. (4)PersonalUse:ItisaviolationofthisPolicytousetheALPRsystemorassociatedscan filesorhotlistsforanypersonalpurpose. associatedscanfilesorhotlistsmaybesubjectto: ·criminalprosecution, civilliability,and/or · administrative sanctions, up to and including termination, pursuant to and consistent 470.5DATACOLLECTIONANDRETENTION andsecurityofdatastoredintheirdatatowers.FlockSafetywillpurgetheirdataattheend ofthe30daysofstorage.However,thiswillnotprecludeBeniciaPoliceDepartmentfrom maintaininganyrelevantvehicledataobtainedfromthesystem afterthatperiodpursuant totheestablishedCityofBeniciaretentionschedule. RestrictionsonuseofALPRData:Informationgatheredorcollected,andrecordsretained by FlockSafetycameras or anyotherBenicia PoliceDepartmentALPRsystemwill not be sold, accessed, orused forany purpose other than legitimate law enforcement orpublic safetypurposes. 470.6ACCOUNTABILITYANDSAFEGUARDS All data will be closely safeguarded and protected by both procedural and technological means. and use of stored data(Civil Codes 1798.90.51;Civil Code S1798.90.53): (a)Allnon-lawenforcementrequestsforaccesstostoredALPRdatashallbeprocessedin accordancewithapplicablelaw. (b)Persons approved to access ALPR data under these guidelines arepermitted to access specificcriminalinvestigationordepartment-relatedciviloradministrativeaction. (c)SuchALPRdatamaybereleasedtootherauthorizedandverifiedlawenforcement (d)EveryALPRDetectionBrowsingInquirymustbedocumentedbyeithertheassociated Benicia Police case number or incident number, and/or a reason for the inquiry. Forsecurityordatabreaches,seetheRecordsReleaseandMaintenancePolicy. 470.7POLICY The policy of theBeniciaPolice Department is to utilize ALPRtechnology to capture and ofthepublic. Becausesuchdata may containconfidentialinformation,it is notopentopublicreview. Cityoritscontractors/subcontractorsforpurposeoffederalimmigrationenforcement, pursuanttotheCaliforniaValuesAct(GovernmentCodes7282.5;GovernmentCodes 7284.2etseq)-thesefederalimmigrationagenciesincludeImmigrationsandCustoms Enforcement(ICE) and Customs and Border Patrol (CPB). 470.8ALPRDATADETECTIONBROWSINGAUDITS ItistheresponsibilityoftheServicesLieutenantortheChief'sdesigneetoensurethatan audit is conducted of ALPRdetectionbrowsinginquiries at least quarterly duringeach prior12-monthperiodtoverifyproperuseinaccordancewiththeaboveauthorizeduses. Theauditshallrandomlyselectatleast10detectionbrowsinginquiriesconductedby departmentemployeesduringtheprecedingsix-monthperiod and determineifeach documentedintheformofaninternaldepartmentmemorandumtotheChiefofPolice.The memorandumshallincludeanydataerrorsfoundsothatsucherrorscanbecorrected. AfterreviewbytheChiefofPolice,thememorandumand anyassociateddocumentation shallbefiled andretainedbyBeniciaPoliceDepartment. 470.9RELEASINGALPRDATA forofficiallawenforcementpurposesorasotherwisepermittedbylaw. theshareddatawill onlybeusedforthepurposes that are alignedwith theBeniciaPolice data gatheredby the City or its contractors/subcontractors forpurpose of federal immigration enforcement, these federal immigration agencies include Immigrations and Customs Enforcement (ICE) and Customs and Border Patrol (CPB). (b) The signed letter is retained on file.Requests for ALPR data by non-law enforcement or nonprosecutorial agencieswill be processed asprovided in the Records Maintenance and ReleasePolicy(Civil Codes1798.90.55). 470.10TRAINING The TrainingSergeant should ensure that membersreceive department-approved training for those authorized to use or access the ALPR system (Civil Code s 1798.90.51; Civil Code $1798.90.53).
