Published withpermission by BeniciaPoliceDepartment AutomatedLicensePlateReaders(ALPRs)- 470.1PURPOSEANDSCOPE Thepurposeofthispolicyistoprovideguidanceforthecapture,storageanduseofdigital data obtained through the use of Automated License Plate Reader (ALPR) technology. 470.2POLICY The policy of theBeniciaPolice Department is to utilize ALPRtechnology to capture and of the public. Becausesuchdatamay containconfidentialinformation,it is notopen topublicreview. 470.3ADMINISTRATION automateddetectionoflicenseplatesalongwiththevehiclemake,model,colorand uniqueidentifiersthroughtheBeniciaPoliceDepartment'sALPR'ssystemand thevendor's vehicleidentificationtechnology.ThetechnologyisusedbytheBeniciaPoliceDepartment to convert data associated with vehicle license plates and vehicle descriptions for official law enforcement purposes, includingidentifying stolen orwanted vehicles, stolen license platesandmissingpersons.Itmayalsobeusedtogatherinformationrelatedtoactive warrants,homelandsecurity,suspectinterdictionandstolenpropertyrecovery. All installation and maintenance of ALPR equipment, as wellas ALPR data retention and access,shallbemanagedbytheDepartmentInformationTechnologyAnalystandRecords Supervisor.TheDepartmentInformationTechnologyManagerwillassignmembersunder his/her command to administer the day-to-day operation of the ALPR equipment and data. 470.3.1ALPRADMINISTRATOR procedurestocomplywith therequirementsofCivilCodes1798.90.5etseq.This includes,butis not limited to(Civil Codes1798.90.51;Civil Codes1798.90.53): (a) A description of the job title or other designation of the members and independent contractorswho are authorized touse or access theALPRsystem orto collect ALPR information. (b) Trainingrequirements for authorized users. (d) No memberof this department shall operate ALPRequipmentor access ALPRdata without first completing department-approved training. (e)Ifpracticable,theOfficershouldverifyanALPRresponsethroughtheCaliforniaLaw isbasedsolelyonanALPRalert.Once analertisreceived,theOfficershouldconfirmthat theobserved licenseplatefromthesystemmatchesthelicenseplateoftheobserved vehicle.BeforeanylawenforcementactionistakenbecauseofanALPRalert,thealertwill be verified through a CLETS inquiry via MDC or through Dispatch. Officers will not take any relatetothepersonoperatingthevehicle,Officersareremindedthattheyneedtohave (Forexample,ifavehicleisenteredintothesystembecauseofitsassociationwitha wantedindividual,Officersshould attempttovisuallymatchthedrivertothedescription of the wanted subject prior to making the stop or should have another legal basis for making thestop.) (f)HotLists.DesignationofhotliststobeutilizedbytheALPRsystemshallbemadebythe ALPRAdministratororhis/herdesignee.Hotlistsshallbeobtainedorcompiledfrom sources as may be consistent with the purposes of the ALPR system set forth in this Policy. HotlistsutilizedbytheDepartment'sLPRsystemmaybeupdatedbyagencysourcesmore system will not have access to real time data.Occasionally, there may be errors in the LPR system'sreadofa licenseplate.Therefore,analertaloneshall notbeabasisforpolice action (other than following thevehicle of interest). Prior to initiation of a stop of a vehicle orotherinterventionbasedonanalert,Departmentmembersshallundertakethe following: (1)VerificationofstatusonaHotList.Anofficermustreceiveconfirmation,fromaBenicia exigentcircumstances). (2)Visual verificationof licenseplatenumber.Officersshall visuallyverifythatthelicense plateofinterestmatchesidenticallywiththeimageofthelicenseplatenumbercaptured (read)bythe LPR,includingboththe alphanumeric characters ofthelicenseplate,state of issue,andvehicledescriptorsbeforeproceeding. Departmentmembers alerted to thefact that an observed motorvehicle's licenseplate is entered asaHotPlate(hit) inaspecificBOLO(beonthelookout) listarerequiredtomakea reasonablebasisexistsbeforeaswornOfficerwouldhavealawfulbasistostopthe vehicle. (3) Officerswill clearall stops from hot listalertsbyindicatingthepositive ALPRHit,i.e., withanarrestorotherenforcementaction.Ifitisnotobviousinthetextofthecallastothe correlationoftheALPRHitandthearrest,thentheOfficersshallupdatewiththe Communications Dispatcher and original person and/or a crime analyst inputting the vehicleinthehotlist(hit). (4)GeneralHotLists(SVS,SFR,andSLR)willbeautomaticallydownloadedintotheALPR systemaminimumofonceadaywiththemostcurrentdataoverwritingtheolddata. (5) All entries and updates of specific Hot Lists within the ALPR system will be documented by the requesting Officer within the appropriate general offense report.As such, specific HotListsshallbeapprovedbytheALPRAdministrator(orhis/herdesignee)beforeinitial thereafterbeaccomplishedpursuanttothe approval oftheOfficer'simmediatesupervisor. The hits from these data sources should be viewed as informational; created solelytobring the officers attention to specific vehicles that have been associated with criminal activity. All HotPlates and suspect information entered into the ALPR system will contain the followinginformationasaminimum: ·EnteringDepartment member's name ·Relatedcasenumber. (h)Login/Log-OutProcedure.Toensureproperoperationandfacilitateoversightofthe ALPRsystem,alluserswillberequiredtohaveindividualcredentialsforaccessanduseof Permitted/lmpermissibleUses.TheALPRsystem,and alldata collected,is theproperty of ThefollowingusesoftheALPRsystemarespecificallyprohibited: warrant,isaviolationofthisPolicytoutilizetheALPRtorecordlicenseplatesexceptthose of vehicles that are exposed topublic view (e.g., vehicles on a public road or street, orthat placetowhichmembersofthepublichaveaccess,suchastheparkinglotofashopor otherbusinessestablishment). (2)HarassmentorIntimidation:ItisaviolationofthisPolicytousetheALPRsystemto harassand/orintimidateanyindividualorgroup. (3) UseBased onaProtected Characteristic.Itisaviolationof thispolicytousetheALPR otherclassificationprotectedbylaw. (4)Personal Use:Itisaviolationof thisPolicytousetheALPRsystemorassociatedscan filesorhot listsfor anypersonalpurpose. associatedscanfilesorhotlistsforthepurposeorknowneffectofinfringinguponFirst Amendmentrights. Anyonewho engages in an impermissibleuse of the ALPRsystem or associated scan files orhotlistsmaybesubjectto: · criminal prosecution, ·civil liability,and/or ·administrativesanctions,uptoandincludingtermination,pursuanttoandconsistent with the relevant collective bargaining agreements and Department policies. 470.5DATACOLLECTIONANDRETENTION andsecurityofdatastoredintheirdatatowers.FlockSafetywillpurgetheirdataattheend maintaininganyrelevantvehicledataobtainedfromthesystemafterthatperiodpursuant totheestablished CityofBeniciaretentionschedule. RestrictionsonuseofALPRData:Informationgatheredorcollected,andrecordsretained by FlockSafetycameras or any other BeniciaPoliceDepartmentALPRsystemwill not be sold, accessed,orused for any purpose otherthan legitimatelaw enforcementorpublic safetypurposes. 470.6ACCOUNTABILITYANDSAFEGUARDS Alldatawillbecloselysafeguardedandprotectedbybothproceduralandtechnological access toanduseofstoreddata(Civil Codes1798.90.51;CivilCodes1798.90.53): (a) All non-law enforcement requests foraccess to stored ALPR data shall be processed in accordancewithapplicablelaw. s (c)SuchALPRdatamaybereleasedtootherauthorizedandverifiedlawenforcement officialsandagenciesforlegitimatelawenforcementpurposes. Cityoritscontractors/subcontractorsforpurposeoffederalimmigrationenforcement, pursuanttotheCaliforniaValuesAct(GovernmentCodes7282.5;GovernmentCodeS Enforcement(ICE)and CustomsandBorderPatrol(CPB). 470.8ALPRDATADETECTIONBROWSINGAUDITS ItistheresponsibilityoftheServicesLieutenantortheChief'sdesigneetoensurethatan auditisconductedofALPRdetectionbrowsinginquiriesatleastquarterlyduringeach prior12-monthperiodtoverifyproperuseinaccordancewiththeaboveauthorizeduses. inquiry meets the requirements established in policy section 470.6(d). The audit shall be documentedintheformofaninternaldepartmentmemorandumtotheChiefofPolice.The memorandumshallincludeanydataerrorsfoundsothatsucherrorscanbecorrected. AfterreviewbytheChiefofPolice,thememorandumandanyassociated documentation shallbefiledandretainedbyBeniciaPoliceDepartment. 470.9RELEASINGALPRDATA The ALPRdata maybesharedonlywith other lawenforcementorprosecutorialagencies forofficiallawenforcementpurposesorasotherwisepermittedbylaw. theshareddatawillonlybeusedforthepurposesthatarealignedwiththeBeniciaPolice Department's policy. TheBenicia Police Department does not permit the sharing of ALPR data gathered by the City or itscontractors/subcontractorsfor purposeof federal immigration enforcement, these federal immigration agencies include Immigrations and Customs Enforcement (ICE) and Customs and Border Patrol (CPB). (b)Thesigned letterisretainedonfile.RequestsforALPRdatabynon-lawenforcementor non-prosecutorial agencies will be processed asprovided in the Records Maintenance and ReleasePolicy(Civil Codes 1798.90.55). 470.10TRAINING forthoseauthorized touseoraccesstheALPRsystem(CivilCodes1798.90.51;Civil Code 1798.90.53).
