Published with permission by Benicia Police Department Automated LicensePlateReaders(ALPRs)- 470.1PURPOSEANDSCOPE The purpose of this policy is to provide guidance for the capture, storage and use of digital dataobtainedthroughtheuseofAutomatedLicensePlateReader(ALPR)technology. 470.2POLICY Thepolicy of theBeniciaPoliceDepartment is to utilize ALPRtechnology to capture and of thepublic. All data and images gathered by the ALPR are for the official use of this [department/office]. 470.3ADMINISTRATION The ALPR technology, also known as LicensePlate Recognition (LPR), allows for the automateddetectionof licenseplatesalongwiththevehiclemake,model,colorand unique identifiers through theBenicia Police Department'sALPR's system and thevendor's vehicleidentificationtechnology.ThetechnologyisusedbytheBeniciaPoliceDepartment toconvertdataassociatedwithvehiclelicenseplatesandvehicledescriptionsforofficial law enforcementpurposes, includingidentifyingstolen orwanted vehicles,stolenlicense platesandmissingpersons.Itmayalsobeusedtogatherinformationrelatedtoactive warrants,homelandsecurity,suspectinterdictionandstolenpropertyrecovery. AllinstallationandmaintenanceofALPRequipment,aswellasALPRdataretentionand access,shallbemanagedbytheDepartmentInformationTechnologyAnalystandRecords Supervisor.TheDepartmentInformationTechnologyManagerwillassignmembersunder his/her command toadministertheday-to-dayoperationoftheALPRequipmentand data. 470.3.1ALPRADMINISTRATOR The Services Division Commander shall be responsible for developing guidelines and procedurestocomplywith therequirementsofCivilCodes1798.90.5etseq.This includes,but is not limited to(Civil Code S 1798.90.51;Civil Codes 1798.90.53): (a) A description of thejob title or other designation of the members and independent contractorswhoareauthorizedtouseoraccesstheALPRsystemortocollectALPR information. (b)Trainingrequirementsforauthorizedusers. (c)AdescriptionofhowtheALPRsystemwillbemonitoredtoensurethesecurityofthe informationandcompliancewithapplicableprivacylaws. (d) Procedures for system operators to maintain records of access in compliance with Civil CodeS1798.90.52. (e) The title and name of the current designee in overseeing the ALPR operation. (f) Workingwith theCustodian of Records on theretention and destruction of ALPR data. (g) Ensuring this policy and related procedures are conspicuously posted on the [department/office]'swebsite. 470.4OPERATIONS UseofanALPRisrestrictedtothepurposesoutlinedbelow.[Department/Office]members unauthorized purp0se (Civil Code s 1798.90.51; Civil Code s 1798.90.53). (a) AnALPR shall onlybeused forofficial lawenforcement business. (b) AnALPR maybeused inconjunctionwith any routine patrol operation or criminal investigation.Reasonable suspicion or probable cause is not required before using an ALPR. (c) While an ALPR may be used to canvass license plates around any crime scene, particular consideration should begiven to usingALPR-equipped cars to canvass areas aroundhomicides,shootingsandothermajorincidents.Partial licenseplatesreported duringmajorcrimesshouldbeenteredintotheALPRsysteminanattempttoidentify suspectvehicles. (d) No member of this [department/office] shall operate ALPR equipment or access ALPR datawithoutfirstcompleting[department/office]-approvedtraining. otherwiseauthorizedtodoso. isbasedsolelyonanALPRalert. 470.5DATACOLLECTIONANDRETENTION TheServicesDivisionCommanderisresponsibleforensuringsystemsandprocessesare vehiclestothedesignated storagein accordancewith[department/office]procedures. AllALPRdatadownloadedtotheservershouldbestoredforaminimumofoneyearandin accordancewiththeestablishedrecordsretentionschedule.Thereafter,ALPRdatashould bepurgedunlessithasbecome,oritisreasonabletobelieveitwillbecome,evidenceina criminalorcivilactionorissubjecttoadiscoveryrequestorotherlawfulactiontoproduce records.Inthosecircumstancestheapplicabledatashouldbedownloadedfromthe serverontoportablemediaandbookedintoevidence. 470.6ACCOUNTABILITY All data will be closely safeguarded and protectedby bothprocedural and technological access to and use of stored data(Civil Code s 1798.90.51; Civil Codes 1798.90.53): (a)AllALPRdatadownloadedtothemobileworkstationandinstorageshallbeaccessible information by name, date and time (Civil Code s 1798.90.52). (b) Members approved to access ALPR data under these guidelines are permitted to access specificcriminalinvestigationor[department/office]-related civiloradministrative action. (c)ALPRsystemauditsshouldbeconductedonaregularbasis. 470.7RELEASINGALPRDATA TheALPRdatamaybesharedonlywithotherlawenforcementorprosecutorialagencies for official lawenforcement purposes or as otherwisepermitted by law,usingthefollowing procedures: (a)Theagencymakes awrittenrequestfortheALPR data thatincludes: 1.Thenameoftheagency. 2.The name of theperson requesting. 3.Theintendedpurposeofobtainingtheinformation. (b) Therequest is reviewed bytheServicesDivision Commanderorthe authorized designee and approvedbeforetherequestisfulfilled. (c)Theapprovedrequestisretainedonfile. RequestsforALPRdata bynon-law enforcement or non-prosecutorial agencieswill be processed asprovided in the Records Maintenance and Release Policy (Civil Code s 1798.90.55). 470.8TRAINING TheTrainingSergeantshouldensurethatmembersreceive[department/office]-approved trainingforthose authorizedtouseoraccess theALPRsystem(Civil CodeS1798.90.51; Civil Code s 1798.90.53). 470.9RELEASINGALPRDATA TheALPRdata maybesharedonlywithother lawenforcementorprosecutorialagencies theshared datawill onlybeusedforthepurposes that are aligned with theBeniciaPolice data gathered by the Cityorits contractors/subcontractors forpurpose of federal CustomsEnforcement(ICE)and CustomsandBorderPatrol(CPB). non-prosecutorial agencies will be processed asprovided in the Records Maintenance and Release Policy (Civil Code s 1798.90.55). 470.10TRAINING The TrainingSergeant should ensure that members receive department-approved training forthoseauthorizedtouseoraccesstheALPRsystem(CivilCodes1798.90.51;CivilCode $1798.90.53).
