PublishedwithpermissionbyBeniciaPoliceDepartment AutomatedLicensePlateReaders(ALPRs)- 470.1PURPOSEANDSCOPE The purpose of this policy is to provide guidance for the capture, storage and use of digital data obtained through the use of Automated License Plate Reader (ALPR) technology. 470.2POLICY Thepolicy of theBeniciaPoliceDepartment is to utilize ALPRtechnologyto capture and ofthepublic. All data and images gathered bythe ALPR are for the official use of this [department/office]. Becausesuchdatamaycontainconfidentialinformation,itisnotopentopublicreview. 470.3ADMINISTRATION automateddetectionof licenseplatesalongwiththevehiclemake,model,colorand uniqueidentifiersthroughtheBeniciaPoliceDepartment'sALPR'ssystemandthevendor's toconvertdataassociatedwithvehiclelicenseplatesandvehicledescriptionsforofficial law enforcement purposes, includingidentifying stolen orwanted vehicles, stolen license platesandmissingpersons.Itmayalsobeusedtogatherinformationrelatedtoactive warrants,homelandsecurity,suspectinterdictionandstolenpropertyrecovery. AllinstallationandmaintenanceofALPRequipment,aswellasALPRdataretentionand Supervisor.The Department Information Technology Manager will assign members under 470.3.1ALPRADMINISTRATOR procedurestocomplywiththerequirementsofCivilCodes1798.90.5etseq.This includes,butisnotlimitedto(CivilCodes1798.90.51;CivilCodes1798.90.53): (a)Adescriptionofthejobtitleorotherdesignationofthemembersandindependent contractorswho are authorized touse or access theALPR system or to collect ALPR information. (b)Trainingrequirementsforauthorized users. (c) A descriptionof howtheALPRsystem will bemonitored to ensure the securityof the informationandcompliancewithapplicableprivacylaws. (d)ProceduresforsystemoperatorstomaintainrecordsofaccessincompliancewithCivil CodeS1798.90.52. (e) The title and name of the current designee in overseeing the ALPR operation. (f) Workingwith theCustodian of Records on the retention and destruction of ALPR data. [department/office]'swebsite. 470.4OPERATIONS Use of an ALPR is restricted to the purposes outlined below. (f)Ifpracticable,theofficershouldverifyanALPRresponsethroughtheCaliforniaLaw isbasedsolelyonanALPRalert. 470.5DATACOLLECTIONANDRETENTION TheServicesDivisionCommanderisresponsibleforensuringsystemsandprocessesare inplaceforthepropercollectionandretentionofALPRdata.Datawillbetransferredfrom vehiclestothedesignatedstorageinaccordancewith[department/office]procedures. AllALPRdatadownloadedtotheservershouldbestoredforaminimumofoneyearandin accordancewiththeestablishedrecordsretentionschedule.Thereafter,ALPRdatashould bepurged unlessithasbecome,oritisreasonabletobelieveitwillbecome,evidenceina criminalorcivilactionorissubjecttoadiscoveryrequestorotherlawfulactiontoproduce records.Inthosecircumstancestheapplicabledatashouldbedownloadedfromthe serverontoportablemediaandbooked intoevidence. 470.6ACCOUNTABILITY All data will be closely safeguarded and protected byboth procedural and technological accesstoanduseofstoreddata(CivilCodes1798.90.51;CivilCodes1798.90.53): (a)AllALPRdatadownloadedtothemobileworkstationandinstorageshallbeaccessible informationby name,date and time (Civil Codes1798.90.52). specific criminal investigation or [department/office]-related civil or administrative action. (c) ALPR system audits should be conducted on a regularbasis. For security or data breaches, see the Records Release and Maintenance Policy. 470.7RELEASINGALPRDATA TheALPRdatamaybesharedonlywithotherlawenforcementorprosecutorialagencies forofficiallawenforcementpurposesorasotherwisepermittedbylaw,usingthefollowing procedures: (a)Theagencymakes awrittenrequestfortheALPRdata thatincludes: 1. The name of the agency. 2.Thenameof thepersonrequesting. 3.Theintendedpurposeofobtainingtheinformation. and approvedbeforetherequestisfulfilled. (c)Theapprovedrequestisretainedonfile. theshareddatawillonlybeusedforthepurposesthatarealignedwiththeBeniciaPolice datagatheredbytheCityoritscontractors/subcontractorsforpurposeofreproductive healthcareinvestigations;federalimmigrationenforcement,thesefederalimmigration agenciesincludeImmigrations and CustomsEnforcement(ICE)and CustomsandBorder Patrol (CPB). non-prosecutorialagencieswillbeprocessedasprovidedintheRecordsMaintenanceand ReleasePolicy(CivilCodes1798.90.55). RequestsforALPRdatabynon-lawenforcementornon-prosecutorialagencieswillbe processed asprovided in the Records Maintenance and Release Policy (Civil Code s 1798.90.55). 470.8TRAINING The TrainingManager should ensure that members receive department-approved training forthoseauthorized touseoraccesstheALPRsystem(CivilCodes1798.90.51;CivilCode 1798.90.53).
