CPRA request — the Flock Safety communication on NCRIC sharing restrictions that the Police Chief identified but the City did not produce

Under the California Public Records Act (Gov. Code sections 7920.000 et seq.), I request copies of the following records held by the City of Benicia and/or the Benicia Police Department. Where a record exists in electronic form, I request it in that electronic form, delivered by email.

This is a narrow request for two specifically identified records. I have kept it short deliberately.

CONTEXT AND WHY THIS IS NOT DUPLICATIVE

On August 6, 2026 the City produced records in response to a separate request. Among them is an email from Chief Mark Menesini to Mayor Steve Young dated June 18, 2026 at 11:34 AM, copying Deputy Chief Edward Criado and City Manager Mario Giuliani. It states, in the Chief’s own words:

"I'm going to forward you an email from Flock that specifically talks about the current
restrictions that have been made limiting NCRIC's ability to share data."

Neither the Flock Safety email he describes, nor the message forwarding it, appears in that production. I could not have asked for either record before August 6, 2026, because their existence was not known to me until the City disclosed it. This request is therefore not a re-service of anything previously asked, and the records sought were not withheld under any exemption – they simply were not produced.

Unless otherwise noted, please treat the relevant time period as June 1, 2026 to the present.

RECORDS REQUESTED

1. The communication from Flock Safety referred to by Chief Menesini in the email quoted above – that is, the email or message from Flock Safety concerning current restrictions limiting NCRIC’s ability to share data – together with any attachments to it.

2. The message by which Chief Menesini forwarded, or attempted to forward, that communication to Mayor Young or to any other person, together with any accompanying text.

   If that forward was never sent, a written statement to that effect fully satisfies this item and no further search is necessary.

3. Any other communication received by the City of Benicia or the Benicia Police Department from Flock Safety between June 1, 2026 and the present concerning any of the following: the Northern California Regional Intelligence Center (NCRIC); the Western States Information Network (WSIN); restrictions, limitations or changes to data sharing between Flock customers and any fusion center; or the San Francisco Police Department’s June 2026 disclosure regarding improper queries of its ALPR data.

   Item 3 is included so that the request still reaches the correct record if the communication described by the Chief is differently titled or differently characterized than his email suggests.

CLARIFICATIONS AND REQUESTS

• If the City takes the position that any item here is already encompassed by an open request, please identify that request and that item specifically, and confirm the date by which the record will be produced under it, rather than deferring this request as a whole. Item 1 in particular concerns a record the City has already identified in writing but has not produced.

• If no responsive record exists for any item, please say so in those words. A statement that a record does not exist, or is not maintained by the City, is fully responsive and closes that item. A statement that a record has “not been located” does not, and I would ask that it be avoided unless the search is genuinely incomplete, in which case please say what remains to be searched and when it will conclude.

• Format: Please provide electronic records in their original electronic format where feasible. Native email format is preferred to a printed or scanned image, so that headers and any attachments are preserved.

• Redactions: If you withhold or redact any record or portion, please cite the specific statutory exemption for each withholding, as required by Gov. Code section 7922.540, and provide all reasonably segregable non-exempt portions (Gov. Code section 7922.525(b)).

• Fees: Please notify me in advance if you anticipate any duplication fees exceeding $20 so I may authorize or narrow the request.

• Timeline: I understand the City must determine whether this request seeks disclosable records and notify me of that determination within 10 calendar days (Gov. Code section 7922.535), and must make records promptly available.
